Elevated Safety, LLC means the Illinois limited liability company named Elevated Safety, LLC and its members, officers, agents, employees, successors, and assigns (referred to hereafter as “Company” or “we” or “us”). By accessing or otherwise using elevatedsafety.com, you agree to the terms and conditions of this Privacy Policy and of the associated Site Use Agreement. If you do not agree, or are legally unable to agree, to the terms of the Site Use Agreement or this Privacy Policy, exit this page and do not access or use the Site.

We may update or change this Privacy Policy from time to time by posting the revised Privacy Policy on the Site. The revised Privacy Policy is effective immediately upon posting. Types of Information about Users Gathered by Company

Company collects information from individuals who visit the Site (“End Users”) and individuals who register for training programs with or make a purchase from the Company (“Customers”). The information we gather about End Users and Customers enables us to provide you with the services you seek and helps us to personalize and continually improve our service to you. Here are the types of information we gather:

Information You Give Us: We receive and store any information you enter on the Site or provide us in any way. For example, you provide us with information when you request additional information about Company services; register for a training program; make a purchase; fill out a survey or provide feedback; or interact with the Site in other ways. We may ask you to provide us with certain personally identifiable information, such as your name, postal address, email address, phone number, or height and weight. When you request additional information from Company, we will also ask you to provide us with your name, your contact information, and the type of information you seek, which the Company may keep on file and which is subject to our privacy policy. When you make a purchase, we will ask you to provide PayPal with credit card information, which PayPal may keep on file and which is subject to PayPal’s privacy policy. The credit card information that you enter may pass through our servers. Some of the information we ask you to provide us is mandatory and some is voluntary. If you do not provide the mandatory information requested for a particular activity, you will not be permitted to participate in that activity. If you choose to provide us with personally identifiable information, you consent to the transfer and storage of that information on the servers of Company or its authorized Third Party Service Providers.

Automatic Information: We receive, analyze, and store certain types of information whenever you interact with the Site whether or not you have requested information from Company or established a Services Agreement with Company. For example, we collect the Internet protocol (IP) address used to connect your computer to the Internet; your login and email address; information about your browser and operating system; and the Uniform Resource Locators (URLs) of the websites you visited before and after our Site. We also place cookies on your computer to prevent fraud, to personalize your experience on our site, and for other purposes. You may be able to delete or disable such cookies, but doing so may prevent you from taking advantage of some or all Company services. We additionally may use software tools to collect information about how you move about and use our Site in order to improve our services.

Information from Other Sources: We may combine information you provide us with information from third parties to correct our records, personalize your experience, or enhance our services. This may include, but is not limited to, information from credit bureaus.

How Company Shares the Information It Receives

Information about our users is a critical part of our business. We are not in the business of selling that information to others, but we may share user information with others in the following ways:

With Authorized Third Party Service Providers: We contract with other companies and individuals to perform functions on our behalf, such as analyzing data, providing marketing assistance, processing credit card payments, and operating our Site; and we may provide your personally identifiable information with these parties. For example, after you register for a training program, we may share your name and email address with the company that maintains our email list and distributes our promotional emails. We encourage our Third Party Service Providers to adopt and post privacy policies; however, the use of your personally identifiable information by such parties is subject to their privacy policies and is not subject to our control.

With Other Websites via Links: Our Site provides links to other websites, which may include accrediting organizations and manufacturers. We may share aggregated, non-personally identifiable data with these third party websites. When you link through to these other websites, they may use cookies and other technology to measure the effectiveness of or personalize their links. We do not have access to and cannot control cookies or other features used by the linked websites, and their information practices are not covered by this Privacy Policy. Via Customer Testimonials: Customers may provide testimonials to be posted on the Site. A testimonial may contain the Customer’s name and city and state of residence. A testimonial is posted only after receiving the Customer’s electronic consent.

To Parent or Affiliated Companies: While we currently do not have a parent company, subsidiaries, or any other companies under a common control, we may in the future, and we may share your personally identifiable information with these companies, in which case we will require them to honor this Privacy Policy.

In a Change of Ownership: As we continue to develop our business, we might merge with or be acquired by another company or sell all or part of our assets to another company. If this happens, the successor company could acquire the personally identifiable information we maintain, but that information would be subject to the successor company’s privacy policy.

For Company’s Protection or the Protection of Others: We may disclose your personally identifiable information if we believe in good faith that such disclosure is necessary to comply with the law or a court order; enforce our Site Use Agreement or other agreements; or protect the rights, property, or safety of Company, our users, or others.

Security of Your Information

When Company collects and stores your personally identifiable information, as outlined above, we use tools such as encryption, passwords, and physical security to protect that information against unauthorized access and disclosure. When you provide us with personally identifiable information, however, you acknowledge that, even with industry standard security measures in place, third parties might unlawfully intercept or access transmissions or private communications. To protect the security of your personally identifiable information during transmission to PayPal, we use Secure Sockets Layer (SSL) software, which encrypts this information. Your entire credit card number must be transmitted it PayPal, but only the last four digits of your credit card number are revealed when confirming your payment. It is also important for you to protect against unauthorized access to both your computer and to any passwords you use on it and to sign off when you finish using a shared computer.

Emails from Company

Once you register for a training program with Company, you become a Company Customer and may receive promotional emails from Company. If you do not want to continue receiving promotional emails from us, you may opt out by clicking on the labeled link at the bottom of the most recent email you receive. You may also email us to notify us that you no longer want to receive promotional emails from us. Please include your name, address, and email address in your email to us. As a condition of registering for a training program with Company, however, you agree to receive from us administrative emails, which relate to your activity on our Site.

Children’s Privacy Issues

Minors under the age of 13 may not use the Company Site. We do not knowingly collect or maintain information from anyone under the age of 13. Minors under the age of 18 may not establish a Services Agreement with Company. Anyone registering for a training program with Company represents that he or she is 18 years of age or older.

Dispute Resolution

You agree that this Privacy Policy shall be interpreted under the laws of the State of Illinois without reference to its conflict of laws provisions. You agree that courts within Cook County in the State of Illinois will have exclusive jurisdiction over all disputes between the parties arising out of or relating to this Privacy Policy. You hereby consent and agree to submit to the jurisdiction of and venue in such courts and waive any argument of forum non conveniens.
